Affiliate Program Terms and Conditions

Introductory Provisions

1. By filling out the registration form, you (the 'user') agree to the full terms and conditions of the www.imago.cz affiliate system and enter into a cooperation agreement with the operator, imago tribe s.r.o., Registered office: Lumírova 536/54, Ostrava, 70030, Company ID: 06020933, VAT ID: CZ06020933, Registered in the Commercial Register maintained by the Regional Court in Ostrava, Section C, Insert 70310 (hereinafter the 'operator').
2. The operator may change these terms but must inform you of any changes via email well in advance. If you do not agree with the changes, you may terminate the cooperation immediately via email (info@imago.cz).
3. After registration, you will place a link containing an identification code on your website, which is automatically assigned to you upon registration. If a visitor clicks this link and places an order in the e-shop (which the operator identifies via the user ID in the link and by storing this ID in the visitor's cookies for 30 days), you will be awarded a commission according to the set rules.
4. You have access to your affiliate account at: www.imago.cz/affiliate. This page provides an overview of your sales, approved commissions, and payouts.
5. You must hold a valid trade license, as operating an affiliate system is considered a continuous gainful activity. If you do not have a trade license, you can try our loyalty program.

Commission Payouts

1. If a visitor purchases goods on the operator's website via your link, you are entitled to a commission, which is credited once the customer completes the purchase. The commission rate may change, but you will be notified of this well in advance via email. Wholesale orders created via a customer's wholesale account are excluded from commissions.
2. The commission is calculated from the total order value (including VAT) and is 6%. Commission settlements are processed upon your request, at most once a month, exclusively via bank transfer in CZK.
3. Payouts are processed if the amount reaches at least 500 CZK. To receive your commission, you must issue an invoice and send it to: info@imago.cz. The invoice due date must be at least 14 days.
4. Alternatively, you can receive your commission in the form of a shopping voucher. In this case, the commission is 8% of the total order value (including VAT). The voucher will be sent electronically to your email address upon your request, at most once a month. This voucher can be used for purchases at imago.cz and cannot be combined with other discounts.

Promotion Rules

1. You agree to operate websites promoting the operator's e-shop in accordance with applicable laws and social standards. You are responsible for the content and links on your website.
2. Spamming, intrusive advertising, and other unfair practices are strictly prohibited. You must not use illegal material or content that infringes on copyright or other rights.
3. You must not mislead website visitors with the appearance of the link. Visitors must not be tricked into clicking on an advertising link (intentionally or accidentally).
4. You agree that your website does not contain any material or links to material that is illegal, infringes on copyrights, trademarks, patents, trade names, or related rights. You must not do anything that damages the operator's reputation.
5. Using PPC advertising with affiliate links directed specifically at imago.cz is prohibited.
6. Using affiliate links on coupon sites, discount portals, their social media, or in email marketing is prohibited.
7. You may use photos from the e-shop to promote the e-shop within the affiliate system.
8. If you need a different presentation format (banners) than those offered by the operator, you must submit your proposal to the operator and may only publish it with the operator's consent.
9. You must not mimic the appearance of the operator's website or otherwise create the impression that your site is the operator's website.
10. You must not use spam methods for advertising (mass emailing, mass creation of newsgroups).
11. If you act illegally, the operator may immediately terminate the cooperation and cancel your affiliate account without compensation for current commissions.
12. You consent to your personal data being archived and used solely in connection with the operation of the affiliate system.

Rights and Obligations of the Operator

1. The cooperation is for an indefinite period. It can be terminated by either party at any time, without giving a reason.
2. The operator may withdraw from the agreement immediately if you breach any of the obligations stated in this agreement.
3. The operator has the right to cancel your registration and affiliate account and withdraw from the agreement at any time, even without giving a reason.
4. The operator may request promotional texts and other materials you use within the affiliate cooperation for approval.
5. The operator reserves the right to refuse the display of advertising spaces and affiliate links on inappropriate websites without stating a reason. The decision on suitability rests solely with the operator.
6. The placement of links or banners by you is subject to random checks by the operator.
7. The operator is not responsible for the content of your website.

GDPR Regulation

The operator fulfills its information obligation towards the affiliate partner regarding the processing of personal data for the purpose of operating the affiliate system, in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), via a separate document.
